DECLARATION CONCERNING ASSESSMENT OF DUES AND DELINQUENT DUES OF PEPPER TREE FARMS IMPROVEMENT ASSOCIATION
WHEREAS:
The Board of Directors (the “Board”) of Pepper Tree Farms Improvement Association (the “Association”), an Illinois Not-for-Profit Corporation, has adopted the following Resolution:
The person or persons who may be, from time to time, the owner or owners (the “Owner”) of each of the lots in Pepper Tree Farms Unit No. 1 and Pepper Tree Farms Unit No. 2 shall, for each calendar year commencing with calendar year 1975, be assessed dues in an amount and payable in a manner as may be determined from time to time by the Board of Directors.
Any such dues which are not paid when due shall bear interest at the annual rate of six percent (6%), and, in addition, penalties may be assessed by the Board of Directors for late payment.
Any owner of any such lot who desires to pay dues for any calendar year subsequent to calendar year 1975, must, as a prerequisite to payment of such dues and the enjoyment of any of the privileges afforded by the payment of such dues, pay all dues, penalties and interest, if any, payable by reason of the failure of said owner, or any previous owner, to pay dues for any calendar year prior to that year, beginning with calendar year 1975.
For calendar year 1975 and for every calendar year thereafter, dues shall be assessed and payable as follows:
a. The owner of each such lot shall, for each calendar year commencing with calendar year 1975, be assessed the sum of fifteen dollars ($15.00).
b. At least thirty (30) days prior to the beginning of any calendar year for which dues are assessed, the Board of Directors shall cause a statement for such dues to be mailed to the owner, or the occupant, of each such lot, and such dues shall be due and payable prior to January 1 of said calendar year, provided that the Board my determine either times for the mailing of such statements and the payment of such dues.
c. In addition to any interest payable, a penalty of five dollars ($5.00) shall be added to any dues assessed against the owner of any such lot which are not paid when due.
Payment of current dues, all past due dues and any penalties and interest owing is a prerequisite to payment of swimming pool use fees and the enjoyment of all other membership privileges.
A Declaration concerning assessment of dues and delinquent dues shall be recorded in the Office of Recorder of Deeds of Cook County, Illinois.
This Resolution may be altered or amended by further Resolution of the Board.
The property subject to the assessment of dues is legally described as follows:
All of the Lots in Pepper Tree Farms Unit No. 1 (except Lot B of Block 3 and Lot a of Block 1 thereof), being a Subdivision of part of the West half of the Norwest quarter of Section 11 Township 42 North, Range 10 East of the Third Principal Meridian, in Cook County, Illinois, according to plat thereof recorded in the Office of the Recorder of Deeds of Cook County, as Document No 20484663 (last number is not legible)
All of the Lots in Pepper Tree Farms Unit No 2 being a Subdivision of part of the West half of the Northwe3st quarter of Section 11, Township 42 North, Range 10 East of the Third Principal Meridian, in Cook County, Illinois, according to the plat thereof recorded in the Office of the Recorder of Deeds of Cook County, Illinois, as Document No. 20484667.
The payment of dues afford certain membership privilege of membership in the Association, in accordance with the bylaws of the Association and resolutions of the Board.
The privilege of membership in the Association is considered by the Board to be of value to owners of the above described property.
The Board has determined that owners of the above described property should contribute to the maintenance and improvement of the properties owned by the Association.
IT IS THEREFORE THE INTENTION of the Board, by this Declaration, not to attempt to create any obligation to pay dues, but rather to advise and put on notice, all persons who are, or may become, owners of any interest in the above-described property of the policy of the Board with respect to assessment for dues.
